Possession of Methamphetamine

The possession of methamphetamine, a Class B drug, is penalized as follows:

  • First Offense: Up to 1 year in jail and up to a $1,000 fine
  • Second Offense: Up to 2 years in jail and up to a $2,000 fine

Additionally, the judge may order mandatory drug and alcohol counseling, community service, or other penalties as part of the sentence.

Trafficking Methamphetamine

If you are charged with trafficking methamphetamine, you could face a minimum of:

  • 2 years but up to 15 years in a state prison if caught trafficking 18 to 28 grams of methamphetamine
  • 3.5 years but up to 20 years in a state prison if caught trafficking 36 to 100 grams of methamphetamine
  • 8 years but up to 20 years in a state prison if caught trafficking between 100 and 200 grams of methamphetamine
  • 12 years but up to 20 years in a state prison if caught trafficking 200 grams or more of methamphetamine
