PHOTOGRAPHING AN UNSUSPECTING PERSON IN THE NUDE CHARGE DISMISSED

My client was charged with photographing an unsuspecting person in the nude (peeping Tom law) when someone allegedly found a camera in his room which allegedly contained a video of someone who did not know he was being taped. I filed a DiBenodetto motion to dismiss (lack of probable cause for the charge to even have been issued). The judge agreed that there was insufficient evidence for a complaint to issue and dismissed the charge.
